Zak Muscovitch led a panel that discussed questionable trademark related decisions. Zak earned a huge victory for the domaining community as the lawyer in the Groovle v. Google case.



Michael Berkens discusses the negatives of the SmoothMove.com decision, which finds it to be bad faith to speculatively own a dictionary phrase domain if there is a trademark on that phrase.

Howard Neu explained his shock with the Chris Bosh decision, which granted Chris Bosh rights to hundreds of domain names of other celebrities’ names even though he didn’t have standing to represent them. In essence, the court turned Chris Bosh into a cybersquatter.

The winner of the worst decision by vote of T.R.A.F.F.I.C. attendees was the WIPO LomaLinda.net/.org ruling, as Zak explained, the first principal in domaining and trademark law is that domain names of locations cannot be trademarked. Nevertheless, the decision grants trademark rights in ‘LomaLinda,’ the California city to a local hospital and university.

    Wow! Crazy…..we need to start filing lawsuits over these cases even if it is not our domain personally.

    We need to fund the ICA so they can attack these bad decisions.
